Miller was reelected with an increase during the 2003 provincial election however, his party, the Progressive Conservatives were reduced to just 24 of the more than 103 legislative seats when the Liberals gained a majority. He also was a supporter of John Tory in the latter’s successful run for the position of succeeding Eves as the head for the Progressive Conservative Party.

Miller got elected into Miller’s seat on the Ontario legislature in the 2001 by-election that was held after Ernie Eves resigned his seat in the legislature. Miller was defeated by Liberal Evelyn Brown by about 4000 votes. On April 22, 2002 Miller became the Parliamentary Assistant of Minister Northern Development and Mines.
